California Approves Cosmetic Fragrance and Flavor Ingredient Right to Know Act

California_Fragrance_LawThe State of California, Governor Gavin Newsom signs the California SB 312, also known as the Cosmetic Fragrance and Flavor Ingredient Right to Know Act of 2020, into law. The act will come into effect on 1 January 2022.

SB 312 would require a manufacturer of a cosmetic product sold in the state to disclose to the Division of Environmental and Occupational Disease Control a list of each fragrance ingredient or flavor ingredient that is included on a designated list, as defined, and a list of each fragrance allergen that is present in the cosmetic product in specified concentrations.

The bill would require the division to post on its existing database of cosmetic product information a list of those fragrance ingredients and flavor ingredients in the cosmetic product and its associated health hazards. By creating a new crime, the bill would impose a state-mandated local program.

Information to be Disclosed to the Center


This bill would require a manufacturer of a cosmetic product sold in the state to disclose to provide the following information:

  • A list of each fragrance ingredient or flavor ingredient that is included on a designated list
  • A list of each fragrance allergen included in Annex III of the EU Cosmetics Regulation No. 1223/2009, and whether it is at a concentration at or above 0.01 percent (100ppm) or 0.001 percent (10ppm) in rinse-off products and leave-on products, respectively
  • Whether the cosmetic product is intended for professional use or retail cosmetic use
  • The Chemical Abstracts Service (CAS) number for each ingredient or allergen that requires disclosure
  • The corresponding Universal Product Code (UPC) for the cosmetic product

To help protect the trade secrets, the section does not require a manufacturer to disclose the weight or amount of an ingredient. The fragrance and flavor ingredients not included in one of the designated lists or in the EU fragrance allergen lists are not required to be disclosed.
