The new Cosmetics Regulation in Europe

A new legal framework for cosmetic & toiletry product passed the EU parliament in March 2009. The Regulation will become immediately enforceable as law in all Member States and will after a transition period repeal the existing Cosmetics Directive 76/768/EEC. Major provisions from the old Directive are resumed, included the animal testing ban, and numerous amendments were made. As such, product notifications will have to be submitted centrally to the EU Commission by an electronic interface and in-market control will be substantially strengthened. New provisions for substance properties exist for nanomaterials and for CMRs. For the first time the provisions for the Product Information File containing the elements for safety evaluation are laid down in a written format with a systematic outline. The manufactures’ responsibilities were upgraded and clearly assigned.On March 24, 2009 the European Parliament approved a new Regulation1) on cosmetics, which is updating the existing EU Directive 76/768/EEC. The type of legislation is a Regulation and as such it is directly applicable in all EU Member States...
